These Terms of Service ("Terms") constitute the agreement between you and the developer ("we", "us", "our") under which the Contacts application (the "App") is supplied. By downloading, installing or using the App you become bound by them. Where they are not acceptable, the App should not be used.

1. Nature of the Service

The App functions as a contacts and dialling tool. It permits you to arrange and search your contacts, place and receive calls, examine call history, identify a caller before answering, and block or filter numbers you prefer to avoid. The availability of particular features depends upon the permissions granted, upon the handset, and upon whether the App has been designated the default dialer.

2. Free Tier and Subscription

The essential contact and calling functions are supplied without charge, and that free tier is funded by advertising. Subscribing produces two effects: advertising is disabled and the App's premium functionality is unlocked. The features covered by a subscription are identified within the App and may be extended or adjusted as the App develops.

3. Billing, Renewal and Cancellation

Subscriptions are sold exclusively via the Google Play billing system at the price displayed prior to confirmation. Absent prior cancellation, a subscription renews automatically at the conclusion of each billing period, the charge being applied to your Google Play account in accordance with Google's terms. Cancellation is effected in the Play Store under "Subscriptions", following which the subscription continues to the end of the period already paid for and access is retained until that point. Uninstallation of the App effects no cancellation whatsoever — only the Play Store may terminate a subscription.

4. Refunds

Refunds are governed by the Google Play refund policy and are assessed and issued by Google rather than by us. Where a charge appears to have been applied in error you may also write to us, and we shall assist so far as we are able, although the final determination in respect of any Play Store refund rests with Google.

5. Minimum Age; Purchases by Minors

Use is permitted from 13 years of age, or from such higher minimum age as the law of your jurisdiction prescribes. A person aged between 13 and 18 requires the permission of a parent or legal guardian, who thereby accepts these Terms on that person's behalf.

A subscription or purchase effected by a minor is valid only where a parent or legal guardian gave prior consent. An adult permitting a minor to use a handset signed in to that adult's Google Play account bears responsibility for purchases made from it. The enabling of purchase authentication within Google Play — requiring a password or fingerprint before each purchase — constitutes the effective safeguard, and we recommend it upon any handset accessible to a child. Where an unauthorised purchase has nonetheless occurred, recourse lies through the Google Play refund process.

6. Acceptance and Subsequent Amendment

Use of the App constitutes acceptance of these Terms. Amendments may be made; the version currently operative, bearing its effective date, is invariably published upon this page, and continued use following an amendment constitutes acceptance of that amendment. Where an amendment is unacceptable, discontinuing use of the App is the remedy available.

7. Data Employed by the App

Subject to the permissions granted, the App works with contact entries, call records and associated device data in order to furnish dialling, caller identification, call history and blocking. Particulars appear in our Privacy Policy, which forms part of these Terms. Personal data is not sold, and disclosure is confined to the providers identified therein.

8. Obligations of the User

The App is to be used exclusively for lawful purposes. Responsibility for the manner in which its dialling, blocking and reporting functions are employed — including compliance with the law of your jurisdiction — rests with you, as does the accuracy of the contact information you maintain within it. The App must not be used to harass any person, to submit false spam reports, to interfere with emergency communications, to circumvent the subscription, or to obtain unauthorised access to any connected system. The App must in no circumstances constitute your sole means of contacting emergency services; the handset's native emergency dialling must remain available at all times.

9. Controls Available to the User

Permissions may be withdrawn through Android settings; contact entries amended or deleted; call history cleared; blocked numbers released; the default dialer changed; and the App uninstalled — each at any time and at your sole discretion.

10. Proprietary Rights and Licence

The code, design, graphics and other materials originating with us constitute our property and enjoy the protection of intellectual property law. You are granted a limited, personal, non-exclusive, non-transferable licence to use the App, together with any premium functionality unlocked by a subscription, for private and non-commercial purposes. Reproduction, modification, redistribution, sale and reverse engineering are prohibited absent our written consent. Your contact entries and other content of your own remain yours throughout.

11. Advertising

Where no subscription is in force, advertising is displayed through third-party networks such as Google AdMob. Any relationship arising between you and an advertiser subsists exclusively between the two of you; we accept no responsibility for third-party advertising content or for the goods and services promoted by it. Advertising ceases for the duration of an active subscription.

12. Disclosure

Information may be disclosed where the law so requires, or where disclosure is reasonably necessary to prevent fraud or abuse, to protect the rights and safety of users, or to enforce these Terms.

13. Termination

You may terminate your use of the App at any time by uninstalling it — noting that a subscription survives uninstallation and requires separate cancellation through the Play Store. Access may be suspended or terminated by us without prior notice where these Terms are breached, where the law so obliges us, or where continued provision of the App would expose us to legal or operational risk. Provisions which by their nature ought to survive termination — proprietary rights, disclaimers, limitations of liability — continue in effect.

14. Exclusion of Warranties

The App is furnished "as is" and "as available", without warranty of any description, whether express or implied. No representation is made that operation will prove uninterrupted or free from error, that every unwanted or spam call will be intercepted, that caller identification will invariably be accurate, or that defects will be remedied.

15. Limitation of Liability

To the fullest extent permitted by law, no liability attaches to us in respect of indirect, incidental, special, consequential or punitive damages — including missed or failed calls, loss of data, loss of contact entries, loss of profit and device malfunction — arising from use of the App or from any inability to use it, notwithstanding that the possibility of such damage may have been drawn to our attention.

16. Disputes

Please write to us first at the address below; the overwhelming majority of matters are resolved in that manner. Where informal resolution proves unsuccessful, the dispute shall be determined under applicable law before the competent courts of the place in which the defendant is located, save where mandatory law directs otherwise.

17. General

Should any provision of these Terms be held invalid or unenforceable, the remainder shall continue in full force. A decision not to enforce a provision upon any given occasion operates as no waiver of it.
